C. Personal data

Personal data is any personal or factual information that readily and unequivocally identifies you. This includes your name, address, phone number, e-mail address, or an online username or password.

D. Scope of collected and used data concerning you, including the purposes of processing

I. Visiting our website

If you merely want to visit our website and view the information found there, there is no need for you to provide any personal information.

We only collect and process data during your visit to our website which your internet browser automatically transmits:

  • data and time of accessing one of our web pages
  • your browser type
  • your browser settings
  • your IP address
  • the pages you visited
  • the internet address of the website where you clicked on a link to access our website (so-called referrer).

We use this data to provide the technical means for you to visit our website. We additionally use this data for statistical purposes in order to enhance the design and layout of your website. Your full IP address is only saved for the duration of your visit. If we are unable to collect this data, it is not possible to transmit and/or display our website content to/on your browser.

II. Using our contact details / contact forms

1. You can get in touch with us directly using the e-mail address posted on our website. We solely collect, process and use the personal data and information that you provide through your e-mail (incl. your e-mail address) in order to process your query or inquiry. This correspondence is saved in keeping with the statutory retention periods and erased whenever such retention periods elapse.

2. You also have the option of using the contact form incorporated on our website in order to direct your query or inquiry to us or leave a request for a return call. In this instance, we collect the following mandatory information in order to respond to your query or inquiry:

  • your first and last name
  • your e-mail address
  • the matter in question

Other data (your company, address and phone number) can be provided on a voluntary basis.

III. Sending job applications

In our website’s job vacancies section, you have the option of sending your job application to the e-mail address posted there. In order to process your application, we require the following data at a minimum:

  • your first and last name
  • your address
  • your e-mail address
  • the vacancy in question (“application for”)
  • your earliest starting date
  • application documents (e.g. curriculum vitae, certificates, references, qualifications)

Needless to say, you are welcome to provide any other data as you deem suitable. We use the aforementioned data to send you a confirmation of receipt, to select suitable candidates, to send invitations to a job interview where applicable, or to return your documents.

IV. Newsletter subscription

If you use our e-mail service for us to send you information, current offers and advertising, we collect and process the following mandatory data, with your consent, in order to send e-mails and fulfil the statutory requirements:

  • Ihre Firma
  • Ihre E-Mail-Adresse
  • Ihren Vor- und Nachnamen
  • Anrede

When you subscribe to our newsletter, we also save the following data in order to record your consent and prevent any abuse of your personal data:

  • date, time and your IP address at the moment you provide your consent
  • date, time and your IP address at the moment you confirm your consent
  • version of the privacy notice at the time you provide your consent as well as the content of the consent in question
  • origin of the data relating to your provision of consent, e.g. "https://www.titgemeyer.de/de/aktuell/newsletter.html"

To subscribe to our newsletter, we use a so-called double opt-in. This means that, based on the e-mail address provided, we send you a confirmation to the specified address requesting that you confirm that you wish to receive the newsletter. Should you confirm your request after receiving the e-mail, we save your e-mail address until such time as you unsubscribe from the newsletter. The sole purpose of saving the e-mail address is to enable us to send you the newsletter. An unsubscribe option can be found at the end of each newsletter.

V. Downloading catalogues, assembly instructions and certificates

You have the option of downloading catalogues, assembly instructions and certificates from our website. To enable this, we process the data outlined under Item D. I.

VI. Use of our e-shop / Creating user profiles (registration)

Only business customers are able to procure articles through our e-shop. This requires registering to use our e-shop and thus creating a user profile.

During the registration process, we collect and use the data transmitted automatically by your internet browser as well as the following mandatory data:

  • date and time of registration
  • personally defined username
  • your e-mail address
  • personally defined password
  • your company
  • your first and last name
  • your address (street, no., post code, town, country)
  • your phone number
  • VAT ID No. for your company

Prior to completing the registration, we contact Creditreform to obtain a credit report on the company you have specified. To qualify for access to our e-shop, we require a valid, positive report from Creditreform.

After registration, we use your username and password for authentification when you log in to your personal profile. In your user profile, you have the option of viewing your existing personal data, including data concerning your orders, and of amending your login data.

We also save the following personal data that you enter when making purchases through our e-shop and which is needed in order to fulfil our contract with you as well as to process any warranty or guarantee claims:

  • data and time of order.

VII. Use of Cookies

Our website uses so-called cookies. These are small text files are sent to your computer by our web server in order to save certain details (e.g. identification features).

If you are using our website anonymously, cookies will only be used to generate statistical evaluations of how the site is used, including the recording of new and returning visitors. We furthermore use cookies to measure the extent to which free content is being used.

If you use our e-shop, cookies are placed in order to identify your browser during your visit, including the various pages that you view, and thus to keep your shopping basket up to date.

Our website can also be displayed even if no cookies are saved. You can disable the placing of cookies in your browser settings or adjust the settings so that you are informed at any time the website intends to place cookies. In this instance, you have the option of whether or not to accept the cookies. To be able to enjoy all the features of our website, it will be necessary, for technical reasons, to fully accept temporary cookies, however.

VIII. Use of web analytics tools

1. Google Analytics

Our website uses Google Analytics, a web analysis service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 (USA). Our service provider is headquartered in a country outside the member states of the European Union ("third country").

Google Inc., has been engaged on the basis of the decision reached by the European Commission on 12.07.2016 according to which an adequate level of protection exists in the USA (Adequacy Decision pursuant to Art. 45 GDPR).

Google Analytics uses cookies, which are placed on your computer and enable analysis of your use of our website. The information generated by the cookie about your use of our website is typically transmitted to one of Google’s servers in the USA and stored there. The use of IP anonymisation on our website ensures that IP addresses are anonymised when recorded (so-called IP masking).

Google uses this information on our behalf in order to evaluate your use of our website, to compile website activity reports, and to provide Titgemeyer with additional services connected with website and internet use. Google will not associate the IP address transmitted by your browser via Google Analytics with any other data held by Google.

We furthermore use the following Google Analytics features:

  • display advertising;
  • remarketing;
  • impression reports in the Google Display Network;
  • Google Analytics reports to measure demographics and interests as well as
  • user IDs.

You can disable Google Analytics for Display Advertising and adjust the displays in the Google Display Network by amending the display settings via the following link: www.google.de/settings/ads. For online advertising purposes, we use Google Analytics remarketing to place advertisements on third-party websites, including Google. This involves cookies being used by us and third-party providers, including Google. It especially includes the combined use of first-party cookies (e.g. Google Analytics cookies) and third-party cookies (e.g. DoubleClick cookies) based on your previous visits to our website, but also the alignment, optimisation and placing of advertisements on this basis.

This also means that we link advertising impressions, other uses of advertising services, and interactions with these advertising services to your loading of our web pages and thus impacting their future delivery. The process also entails using interest-based advertising from Google. Data retrieved through these means as well as visitor data from third-party providers (e.g. age, gender, interests) are recorded and analysed by us in Google Analytics. The data is also used for advertising impressions, other uses of advertising services, and interactions with these advertising impressions and advertising services. Under no circumstances is this data merged with other personal data, however. The described remarketing is not limited to your use of our website on one individual device but enables us to display interest-based advertising across all devices you use.

We use the User ID function to record user behaviour on a variety of devices (e.g. tablets, notebooks, smartphones) and across various sessions, and to associate the User ID. This enables us to manage and measure marketing activities regardless of the device used and based on specific needs. The issuing of User IDs and evaluation of user behaviour always occurs in anonymised form.

You may deny the placing of cookies by selecting the appropriate settings in your browser software; however, please note that if you do so you may not be able to use the features offered by our website in full. You can also prevent data recorded by the generated cookie and relating to your use of our website (incl. your IP address) from being transmitted to Google and also this data being processed by Google by downloading and installing the browser plugin available at [https://tools.google.com/dlpage/gaoptout].

2. Piwik

Our website uses Piwik open source web analytics software that provides a statistical analysis of visits to our website. Piwik uses ‘cookies‘, which are text files placed on your computer to help the website analyse how you use the site. The information generated by the cookie about how you use our website is saved to the provider's server in Germany. The IP address is anonymised immediately after being processed and prior to it being saved. You may deny the installation of cookies by selecting the appropriate settings in your browser software; however, please note that if you do this you may not be able to use the features offered by this website in full. Should you click on a corresponding link, your browser will take you to the linked site. The corresponding provider is responsible for the recording and processing of your personal data on the linked platform.

E. What is the legal basis for processing your data?

We process personal data in compliance with the requirements of the EU General Data Protection Regulation (GDPR) as well as national regulations governing data protection (Federal Data Protection Act – BDSG) for the following purposes:

We process your personal data for the purpose of providing content on our website for users to retrieve. The processing of such data is undertaken on the basis of Art. 6 (1) Sentence 1 (b) GDPR.

The same applies to the processing of personal data when handling your queries or inquiries submitted via our contact form.
We furthermore process your personal data in order to perform a contract concluded with us via our e-shop and to process warranty and guarantee claims. The processing of such data is undertaken on the basis of Art. 6 (1) Sentence 1 (b) GDPR.

Job application data that you submit to us is processed in order to carry out the application process on the basis of Art. 6 (1) 1 Sentence 1 (b) GDPR, as well as Section 26 BDSG in its version of 25.05.2018.

We furthermore process your personal data provided that you have furnished your consent for us to do so. In such a case, the processing is undertaken on the basis of Art. 6 (1) Sentence 1 (a) GDPR. When obtaining your consent, we will inform you of the specific purpose of the envisaged processing. Any consent provided to us can be withdrawn by you at any time with future effect. This equally applies to any consent which you may have provided prior to 25 May 2018. Information concerning the possibility of withdrawing your consent will be provided at the time that you furnish us with your consent. We require your consent, for example, in order to send you our newsletter.

Finally, we process data if, and to the extent, that we have a legitimate interest, except where such interest is overridden by your interests or fundamental rights which require the protection of personal data. In such a case, the processing is undertaken on the basis of Art. 6 (1) Sentence 1 (f) GDPR. The processing in this form includes the use of the aforementioned cookies as well as the use of tools in order to analyse how you use our website.

F. Do we transmit your data to international organisations or third countries?

For the purpose of processing your data, we have added the aforementioned technical service providers. Wherever these companies process data in a country outside the European Union (third country), we have made reference to this in the information provided on the relevant service provider.

If, in future, we engage additional or other service providers as part of the running of this website which do not process website user data in a member state of the European Union, this will only occur if, on the basis of the decision of the European Commission, it is clear that an adequate level of protection exists in the third country in question (Art. 45 GDPR) or, in the absence of such a decision, appropriate safeguards exist to protect your data and enforceable rights and effective legal remedies are available to you (Art. 46 GDPR). In each instance, we will conclude a processing agreement with the relevant service provider in line with the EU's standard agreement clauses prior to forwarding any data.

We save your personal data for as long as you use our website. If, and to the extent, that your data is subject to specific retention periods under tax, commercial or any other law, we will save the data until the retention periods in question have expired. If you send us your job application documents via the contact forms provided on our website, we will save these documents until the application process has been concluded.

I. Information on data privacy laws / supervisory authority

Every user has the right to obtain information concerning the personal data saved on them at Titgemeyer and how such data is processed (Art. 15 GDPR); the right to have incorrect/incomplete personal data rectified (Art. 16 GDPR); the right to have personal data erased after fulfilment of the contract (Art. 17 GDPR); provided this does not conflict with any legal obligations to preserve the data; the right to have the processing of their data restricted (Art. 18 GDPR); the right to object (Art. 21 GDPR); and the right to data portability (Art. 20 GDPR.

Should you have given Titgemeyer your consent to your data being processed, you can withdraw such consent at any time without affecting the lawfulness of the processing that was undertaken on the basis of the originally issued consent prior to it being withdrawn.

You also have the right to lodge a complaint with the incumbent supervisory authority in acc. with Art. 77 GDPR.

J. Information on the existence of the right to object pursuant to Art. 21 GDPR

Existence of the right to object in specific situations
If there are grounds in your particular case, you have the right to object to your data being processed when the processing is deemed a necessary task in the public interest or in the exercise of an official authority (Art. 6 (1) Sentence 1 (e) GDPR) and the task has been assigned to Titgemeyer. This equally applies in the case of any profiling performed on the basis of the aforementioned provision. Should you object to the processing, we will cease processing your data for these purposes unless we can demonstrate the existence of compelling legitimate grounds for the processing which override your interests, rights and freedoms or that the processing serves the establishment, exercise or defence of legal claims.

 

Existence of the right to object to the processing of data for advertising purposes, including any associated data pre-processing (profiling)
We process your data in order to contact you with advertising and, in this context, carry out the processing of data in order to align our marketing activities to your interests (profiling). This form of processing for direct advertising purposes is performed on the basis of an overriding interest on the part of Titgemeyer.

You can object, at any time, to your personal data being processed for direct advertising. This equally applies in the case of profiling to the extent that the data is used to contact you with advertising. Should you object to the processing for direct advertising purposes, your data will no longer be processed for such purposes.

K. Do Titgemeyer users have to provide personal data?

For technical reasons, it is necessary for us to record and process the data stated in Item D.I. in order for you to use our website. Without this data, we will not be in a position to transmit our website's content. What is more, we can only process your query or inquiry if you submit the data marked as mandatory in the contact forms. The same applies in the case of job applications.

It is also necessary for you to provide the other data specified under Item D. If not, we will be unable to execute your orders, process job applications, deliver newsletters, respond to inquiries or send brochures or forms.

L. Is automated decision-making used?

As a customer, you have the right not to be subjected to any form of automated decision-making – including profiling – which has any legal effect on you or adversely affects you in any other similar manner (Art. 22 GDPR). We do not deploy automated decision-making in any shape or form. Should we, by way of exception, carry out this form of processing, we will notify you in advance.

M. Profiling

We sometimes use automated processing for user data when this serves to inform users of our website about products and services which may be of interest to them and to optimise our website. To this end, we take account of user behaviour (incl. length of visit; pages viewed; word searches; the site from which the user accessed our website).

N. Security measures

We implement technical and organisational measures to safeguard personal data, in particular from accidental or wilful manipulation, loss, destruction, or unauthorised third-party access. These measures include encrypting our entire website, including any order transactions, using SSL technology (https://).

Our security measures are enhanced on an ongoing basis in keeping with technological changes. Moreover, we only deploy employees to record and process personal data who have been obliged to observe data secrecy.
